1. 1. Introduction & Definitions

HosteDomains is an activity operated under the sole proprietorship with the trade name Setin Designs, owned by Ilias I. Settas, whose principal business activity is Web Development. The business is registered at Iera Odos 294, 122 43 Aigaleo, Attica, Greece (Tax ID: EL049460039, Tax Authority: KEFODE Attikis). Official communication regarding HosteDomains shall take place exclusively via email at info@hostedomains.com. HosteDomains does not operate as a mass-market hosting provider. Hosting and domain name services are provided as a complementary component within the framework of a broader collaboration with the client, which may include, depending on the case, web development, technical support, or digital marketing services. For the better management of client projects, HosteDomains acts as an intermediary reseller of accredited registrars (such as Netim, eNom, or other partners as applicable), ensuring the availability of a management API within the HosteDomains platform that allows clients to manage their domain names (e.g., DNS settings, nameservers, renewals). By using HosteDomains services, the client acknowledges and agrees to be bound by the policies of such third-party registrars and accepts full responsibility for any claims arising from unlawful or improper use of a domain name. Definitions
  • Client: any individual or legal entity using the services of HosteDomains.
  • Services: the full range of domain name registrations, web hosting, SSL certificates, email services, DNS management, and related services.
  • Account: the client profile within the platform (client area) through which services are managed.
  • Domain Name: any domain name registered or transferred through HosteDomains.
  • Ticket: an official support request submitted by the client via the client area.
  • Hosting Package: the available hosting services (shared, VPS, dedicated).
  • Broader Collaboration / Technical Support Package: additional Setin Designs packages that are a prerequisite for the active use of HosteDomains services.
  • SSL Certificates: digital security certificates used for data encryption.
  • Email Services: email accounts provided as part of the hosting packages.
   
  1. 2. Provision of Services

HosteDomains provides the Client with services that include, but are not limited to:
  • Domain name registration and transfer
  • Web hosting services (Shared, VPS, Dedicated)
  • DNS management
  • Email Services, including primarily email security and spam filtering packages
  • SSL Certificates and related security services
All services are provided on a managed basis, meaning that the Client is supported directly by the Setin Designs team, rather than impersonally through third parties. Setin Designs serves as the primary point of contact for the technical management, monitoring, and support of projects. HosteDomains provides a Service Level Agreement (SLA) with a 99.99% uptime guarantee per project, per quarter, provided there is an active broader collaboration in which Setin Designs acts, at minimum, as the project’s technical manager. This guarantee applies to the overall availability of the project and not to individual infrastructure components, which depend on cooperating datacenter providers. Additionally, for hosting services, a 30-day money-back guarantee is provided from the date of activation, with the exception of domain name services, SSL certificates, and any other service subject to the regulations of third-party providers.    
  1. 3. Minimum Collaboration Framework

HosteDomains does not provide hosting as a “naked” package that the client takes and manages on their own. Each hosting plan comes with a minimum mandatory collaboration with Setin Designs, ensuring that every project receives ongoing technical oversight and operates reliably over time. This minimum collaboration is defined by the formula: Syn(min) = BP + AT
  • Syn(min): The minimum collaboration framework required for hosting services to remain active.
  • BP (Basic Plan): The Basic Website Technical Support Plan, mandatory for all clients and billed monthly. It covers everyday tasks that keep a website operational (CMS, theme and plugin updates, PHP upgrades and compatibility tuning, post-update conflict fixes, error checks, security scans for malware, test submissions and orders, incident advisory).
  • AT (Additional Tasks / Exclusive Collaboration Areas): Specific areas of work that fall under the exclusive responsibility of Setin Designs and must be assigned to us, with additional fees. The scope of AT depends on the hosting type.
Beyond BP and AT, every HosteDomains plan is provided as a Premium / Managed service. This means that essential technical operations directly related to the hosting environment (server administration, WHM/VPS settings, PHP parameter adjustments, basic security hardening and anti-bot rules, email deliverability troubleshooting) are already included in the hosting package price and are not billed separately. Clients can rest assured that the entire stack — from WHM to the website frontend — is monitored and managed by us. 3.1 Hermes & Zeus Premium Shared Hosting For Hermes and Zeus plans, the minimum collaboration is limited to the BP (Basic Plan). There are no exclusive collaboration requirements (AT = empty). Clients may work with third-party developers for development or content, provided that all work takes place outside the server environment. Server/WHM administration remains exclusively with HosteDomains (Managed Core, included), while all live deployments or migrations to production must be performed by HosteDomains and are billed separately. 3.2 VPS Managed Hosting For VPS hosting, stricter collaboration is required: BP + AT. The AT covers the following exclusive collaboration areas:
  • integration and management of conversion tracking mechanisms (Google Ads, Meta Pixel, product feeds),
  • compliance tasks related to GDPR Consent Mode v2. For these areas, the client is obliged to collaborate exclusively with Setin Designs, under additional fees (recurring or one-off, depending on the case). No co-management or third-party administrators are allowed in the VPS environment.
3.3 Dedicated Managed Servers With Dedicated Servers, collaboration reaches the highest level: BP + AT full scope. Here, the AT extends to the entire service portfolio of Setin Designs, including:
  • website development and redevelopment,
  • redesigns & performance improvements,
  • Google Ads, Meta Ads, and digital marketing,
  • SEO, newsletters, content creation,
  • photography, graphic & digital design,
  • hosting and comprehensive technical support services.
The client is required to work exclusively with Setin Designs across all these areas. Third-party administrators, co-management, or external handovers are not permitted. All AT-related tasks are billed separately, either as recurring plans or one-off projects. 3.4 Breach of the Collaboration Framework If a client repeatedly violates the minimum collaboration framework and, instead of aligning, chooses to terminate their hosting with HosteDomains, Setin Designs reserves the right to:
  • claim reasonable compensation of up to six (6) times the applicable recurring hosting fee (regardless of whether it is monthly, quarterly, or annual), and/or
  • place the account under “Suspended” status, allowing project rescue/transfer only through a migration service performed exclusively by Setin Designs, at a cost determined on a case-by-case basis.
 
  1. 4. SLA – Service Level Agreement

4.1 Scope & Conditions This SLA applies per project and per quarter and is valid only if the minimum collaboration framework is maintained (see §3 Syn(min) = BP + AT) and all incidents are submitted via the ticketing system in the client area. 4.2 Uptime Commitment We guarantee 99.99% uptime per project, per quarter. This means total downtime does not exceed 0.01% of the quarter (~13 minutes over 90 days). “Project” refers to the main production website/application hosted under the plan (not staging/sandbox or third-party services outside our infrastructure). 4.3 Measurement Method
  • Monitoring is conducted from multiple geographic locations.
  • Downtime is recorded when there is continuous failure from at least two regions (HTTP 5xx, connection timeout, TLS failure) for ≥60 seconds.
  • Short interruptions <60s or single-point failures are treated as network noise and not counted.
4.4 Exclusions The SLA does not cover downtime caused by:
  • Scheduled maintenance with prior notice.
  • Force majeure / acts of God.
  • Upstream third parties outside our reasonable control (telecom providers, registries/registrars, external DNS/CDN/email services, etc.).
  • Third-party or client code interventions causing application errors.
  • Violations of the AUP (see §8), DDoS/abuse, or excessive resource consumption.
  • Failure to comply with technical recommendations from Setin Designs (e.g. adoption of CDN/Cloudflare, software upgrades, caching/security hardening). Accumulated neglect leading to severe malfunction or system collapse will not be counted as downtime under this SLA.
4.5 Actions & Priorities
  • For P1 incidents (production website unavailable), immediate recovery procedures are triggered based on monitoring alerts and the ticket.
  • Resolution order follows severity & priority (see §9 – Technical Support).
4.6 SLA Credits (Service Credits) — Tiered Scale If, at the end of a quarter, actual uptime falls below 99.99%, the client may request a service credit via ticket within 10 business days of quarter close. Credits are applied against future invoices (no cash refunds) and scale as follows:
  • 99.99% – 90.00%10% credit
  • 89.99% – 80.00%20% credit
  • 79.99% – 70.00%30% credit
  • 69.99% – 60.00%40% credit
  • <60.00%50% credit (maximum)
Credits are calculated on the recurring hosting fee for the quarter and are subject to the liability limitations in §11. Example (Smart Village 42€ + VAT / year): Annual fee 42€ ⇒ per quarter €10.50. If uptime for the quarter = 89.50%, this falls under the “89.99%–80.00%” tier ⇒ 20% credit€2.10 applied to the next renewal. 4.7 Levels by Hosting Type (indicative)
  • Shared (Hermes/Zeus): Availability monitoring and recovery within the managed scope.
  • VPS Managed: Proactive actions on the hosting layer, combined with the exclusive collaboration areas (AT) of §3.2 (tracking & GDPR Consent Mode v2).
  • Dedicated Managed: Top-priority management across infrastructure and application layers, according to the full-scope AT of §3.3.
   
  1. 5. Terms of Collaboration

5.1 General Principle Hosting through HosteDomains is provided exclusively within the framework of a broader collaboration with Setin Designs. We do not offer “hosting-only” or standalone hosting services detached from technical support, development, or project management. 5.2 Complementary Nature of Hosting HosteDomains hosting has always been a complementary service tied to projects undertaken by Setin Designs, such as website development, redesign, or technical management. It was never offered as an autonomous commercial product on the open market. 5.3 Past Deviations It is acknowledged that in certain cases, after the conclusion of an initial project collaboration, some clients renewed standalone annual hosting plans without an active support framework. Such practice did not reflect the intention or policy of Setin Designs and is hereby terminated under these Terms. From now on, all hosting requires an active minimum collaboration framework (Syn(min)) as defined in §3. 5.4 Right of Refusal or Termination HosteDomains/Setin Designs reserves the right to refuse or terminate hosting services if the Client:
  • does not comply with Syn(min),
  • neglects support or coordination processes, or
  • otherwise undermines the proper management and cohesion of the project.
5.5 Breach Consequences In cases of repeated refusal to comply with Syn(min), the consequences described in §3.4 shall apply (compensation clause or account suspension with migration allowed only through Setin Designs).  
  1. 6. Payments & Billing

6.1 Prepaid Basis All services (hosting, domain names, SSL, email services) are provided on a prepaid basis. Activation or renewal of any service occurs only after full payment of the corresponding invoice. 6.2 Billing Cycles
  • Charges are applied according to the selected billing cycle (monthly, quarterly, annual, multi-year, etc.).
  • The full cycle fee applies in all cases; no partial refunds are issued for early termination.
  • Domains, SSL, and related services must be renewed strictly before expiration to ensure continuity of service.
6.3 Late Payments
  • If payment is not received by the service expiry date, the account is placed in Suspended status.
  • If the outstanding balance remains unpaid for more than 30 days after expiry, the service is considered terminated and all related files/data are permanently deleted without further notice.
  • The Client bears sole responsibility to have secured backups prior to permanent deletion.
6.4 Refunds
  • No refunds are provided for services that have already been activated, unless explicitly stated otherwise (e.g., a 30-day money-back guarantee for specific hosting packages).
  • Refunds do not apply to:
    • Domain names (registrations, renewals, transfers),
    • SSL certificates,
    • Breach of Terms of Service or AUP.
6.5 Pricing Policy
  • HosteDomains/Setin Designs reserves the right to adjust service pricing and fees, with prior notice published on the website or client area.
  • Price changes do not affect already paid billing cycles; they apply only upon the next renewal.
   
  1. 7. Domain Names

7.1 General Principles HosteDomains acts solely as a Reseller of domain name registration services through partner registrars (e.g., Netim, eNom). It is not an accredited Registrar. All registrations are made in the Client’s name (Domain Holder / Registrant) as shown in WHOIS, who bears full responsibility for the domain’s use. HosteDomains / Setin Designs holds no ownership rights. Domain-related services are limited strictly to registration, renewal, transfer, and DNS management. No legal protection, trademark services, or related services are provided. 7.2 Definitions
  • Registry: Entity managing a specific TLD (e.g., Verisign for .com).
  • Registrar: ICANN-accredited entity processing registrations (e.g., Netim, eNom).
  • Reseller: HosteDomains, intermediary between Client and Registrar.
  • Domain Holder (Registrant): The Client, legal owner in WHOIS.
  • WHOIS Data: Contact/admin data required by ICANN/Registrars. In case of conflict, ICANN and Registry/Registrar definitions prevail.
7.3 Client Obligations The Client:
  • Must keep WHOIS data accurate and updated. Inaccurate or incomplete data may result in suspension/cancellation of the domain by the Registrar without HosteDomains liability.
  • Bears full responsibility for all actions carried out via their account, even by third parties with or without consent.
  • Agrees to comply with ICANN, Registry, and Registrar policies. In case of conflict with these Terms, ICANN/Registry rules prevail.
  • Accepts that their contractual relationship exists solely with HosteDomains / Setin Designs. Partner registrars (e.g., Netim) bear no liability towards the Client.
  • Must update WHOIS information within seven (7) days of any change. Failure to do so, or providing false/inaccurate details, may result in suspension or cancellation of the domain name by the Registrar, without any liability on the part of HosteDomains / Setin Designs. Furthermore, if the Registrar or the competent authorities (ICANN, Registry) request verification of details, the Client must respond within ten (10) days. Failure to respond within this timeframe constitutes a material breach and justifies suspension or cancellation of the domain name.
7.4 Registration & Transfer Procedures
  • Registrations/transfers follow ICANN and Registrar rules.
  • Client must provide valid EPP/Auth code and ensure domain is not under Registrar Lock.
  • Transfers are not permitted within 60 days of registration or previous transfer.
  • Where FOA email confirmation is required, non-response results in failure.
7.5 Domain Name Lifecycle Per ICANN:
  • Active until expiry.
  • Grace Period (if Registry supports).
  • Redemption Period with extra fees.
  • Pending Delete before final deletion. Once deleted, domain is open to third parties. Client bears sole responsibility for timely renewal.
Renewal notices are sent exclusively by the Registrar and/or the Registry in accordance with ICANN regulations. HosteDomains / Setin Designs bears no liability if the Client does not receive or does not read such notices. The Client bears sole responsibility for the timely renewal of the domain name. 7.6 Fees & Refunds
  • All services are prepaid.
  • Registrations, renewals, transfers are final & non-refundable.
  • Redemption carries additional fees per TLD.
  • In case of chargeback/non-payment, HosteDomains may temporarily register the domain in its own name until settlement.
7.7 Suspension & Deletion Registrars or Registry Operators may enforce measures (suspension, deletion, transfer) for domains in violation of rules. HosteDomains is required to cooperate in executing such measures. 7.8 Disclaimer of Liability HosteDomains / Setin Designs provides no warranties beyond those of Registrars/Registries. It bears no liability for any loss, delay, or malfunction arising from registrar processes.  
  1. 8. Acceptable Use Policy (AUP)

8.1 Reference to AUP Use of HosteDomains services is governed by the Acceptable Usage Policy (AUP), which is published and updated at: 👉 https://hostedomains.com/acceptable-usage-policy.php Acceptance of these Terms also constitutes full acceptance of the AUP. In the event of any discrepancy, the provisions of the AUP shall prevail. 8.2 Core Prohibitions Services must not be used for:
  • sending unsolicited email (spam), phishing, scamming,
  • distributing malware (trojans, backdoors, malicious scripts),
  • hosting, storing, or linking to content that infringes intellectual property rights,
  • hosting content that is illegal, abusive, pornographic, or exploitative of minors,
  • abuse of system resources (excessive CPU, RAM, disk, or bandwidth consumption),
  • bulk emailing, proxies, bots, link farming or similar abusive practices.
8.3 Complaints & Trademarks The Client must comply with any legitimate request regarding trademark or intellectual property rights. In cases of complaints about trademark or copyright infringement, HosteDomains may suspend or terminate accounts without prior notice. 8.4 HosteDomains Rights HosteDomains reserves the right to:
  • suspend or terminate services without notice in case of violation,
  • cooperate with relevant authorities or third parties during investigations of complaints,
  • review and update the AUP at any time by posting the revised version at the above link.
 
  1. 9. Technical Support

9.1 Support Channels All requests related to hosting or domain names must be submitted exclusively through the ticketing system in the client area.
  • Tickets are automatically logged, maintain client-specific history, and are handled on a priority basis according to severity.
  • Phone calls or emails outside the ticketing system are not considered official support channels and do not ensure SLA coverage.
9.2 Scope of Support HosteDomains/Setin Designs provides support covering:
  • hosting management (cPanel/WHM, DNS, email accounts),
  • performance monitoring and optimization,
  • troubleshooting issues related to the server environment and our infrastructure,
  • advisory on security incidents or errors (incident advisory).
Support does not include resolving issues caused exclusively by third-party developers or custom modifications outside the management framework. In such cases, HosteDomains may provide consulting or services under additional fees. 9.3 SLA & Priorities Support requests are handled in accordance with the SLA described in §4.
  • Incidents causing downtime are classified as P1 – High Priority and addressed immediately.
  • Configuration/optimization requests are classified as P2 – Normal Priority.
  • Information/advisory requests are classified as P3 – Low Priority.
9.4 Client Obligations The Client must:
  • submit requests clearly, including screenshots/examples where relevant,
  • follow the instructions of the support team for testing or confirming actions,
  • refrain from seeking resolution through unofficial channels (e.g., phone calls without ticket).
 
  1. 10. Backups

10.1 Client Responsibility The Client bears sole responsibility for maintaining independent backups of their content and data. HosteDomains accepts no liability in the event of data loss, regardless of whether additional backup services have been provided. 10.2 Backups Provided by HosteDomains
  • For Shared Hosting plans, HosteDomains performs regular backups (e.g., daily or weekly), offered strictly as a supplementary service.
  • For VPS and Dedicated Servers, Managed Backups are provided, with enhanced monitoring and safeguards.
  • In all cases, such backups are considered complementary and do not constitute a guarantee of full data preservation or recovery.
10.3 Restore Requests
  • The Client may request restoration from an available backup via the ticketing system.
  • The first restore per service cycle is provided free of charge.
  • Any additional restore requests may be subject to fees, depending on the type and complexity of the request.
10.4 Limitations
  • HosteDomains is not responsible for failed backups caused by external factors (e.g., poor coding practices by third-party developers, plugin incompatibilities, storage overages).
  • The Client is required to maintain additional independent copies in separate storage, especially for critical projects.
 
  1. 11. Liability & Limitations

11.1 HosteDomains / Setin Designs Liability
  • HosteDomains / Setin Designs shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data loss, or business interruption.
  • Any liability shall be limited exclusively to direct damages resulting from proven negligence on the part of HosteDomains.
11.2 Maximum Liability The maximum compensation payable by HosteDomains / Setin Designs to the Client, for any reason (contractual or extra-contractual), shall in no event exceed €250 or the total amount paid by the Client for the service concerned, whichever is lower.   11.3 Client Responsibility for Content The Client bears sole responsibility for:
  • all content hosted under their account,
  • all activities conducted through the services,
  • compliance with applicable law, these Terms, and the Acceptable Use Policy.
11.4 Third-Party Claims In the event of claims or demands for compensation from third parties (e.g., registrars, datacenter providers, rights organizations, or affected parties) arising from the Client’s unlawful or abusive behavior, the Client shall bear full responsibility for covering any related costs, compensation, or fines. 11.5 Liability Exclusions HosteDomains shall not be liable for damages resulting from:
  • acts or omissions of third parties (e.g., upstream providers, registrars),
  • force majeure (fire, flood, war, government action, strikes, etc.),
  • the Client’s failure to follow our recommendations or instructions for critical preventive measures (e.g., firewall/CDN implementation, software upgrades, security parameter adjustments).
11.6 Responsibility for Account Access The Client bears full and exclusive responsibility for all actions carried out through their HosteDomains account, whether performed by themselves or by any third party who has obtained access in any manner. HosteDomains / Setin Designs shall not be liable for any damage or loss arising from such use. 11.7 No Additional Warranties for Domains HosteDomains / Setin Designs provides no additional warranty regarding the registration or renewal of domain names beyond those expressly provided by the relevant registrar (ICANN, Registry, Netim, eNom, etc.).    
  1. 12. Modifications of Services & Terms

12.1 Service Modifications HosteDomains reserves the right to upgrade, modify, or adjust the technical characteristics of its services (servers, software, network infrastructure, upstream providers) whenever deemed necessary for reasons of:
  • security,
  • stability,
  • performance,
  • compliance with new regulations or industry standards.
Such changes may affect the operation of hosted projects without this being considered a breach of this Agreement. 12.2 Terms Modifications HosteDomains/Setin Designs may amend these Terms at any time. Changes shall take effect once published on the HosteDomains website. The Client is responsible for reviewing the Terms on a regular basis. Continued use of the services after any modification constitutes acceptance of the revised Terms. 12.3 Client Notifications HosteDomains may notify Clients of modifications via:
  • email,
  • notifications within the client area,
  • or announcements on the website.
The choice of communication method remains at the sole discretion of HosteDomains. 12.4 Validity of Notifications Any notices sent by HosteDomains / Setin Designs via email, the client area, or the website shall be deemed valid and binding. The Client is responsible for keeping their contact details up to date. 12.5 Subcontracting HosteDomains / Setin Designs may subcontract parts of the service delivery to partners or third-party providers (e.g., datacenters, domain registrars), while remaining fully responsible towards the Client for proper performance.    
  1. 13. Legal & Jurisdiction

13.1 Governing Law This Agreement is governed by Greek Law and European Union legislation (including GDPR and ICANN policies applicable to domain names). 13.2 Jurisdiction Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the Courts of Athens, Greece. 13.3 Prevalence of Terms In the event of a conflict between these Terms of Service and any other documents or policies (e.g., AUP, SLA, agreements with third-party registrars), the text of these Terms of Service shall prevail, unless explicitly stated otherwise. 13.4 Severability If any provision of this Agreement is held to be invalid or unenforceable by a competent court, the remaining provisions shall remain in full force and effect. 13.5 Waiver No failure or delay by HosteDomains / Setin Designs in exercising any right shall operate as a waiver of that right. 13.6 Assignment The Client may not assign or transfer this Agreement without prior written consent of HosteDomains / Setin Designs. HosteDomains / Setin Designs reserves the right to assign or transfer it to third parties. 13.7 Logs as Evidence The electronic records (logs) maintained by HosteDomains / Setin Designs in connection with the use of the services (such as server, ticketing, and monitoring logs) shall constitute full and binding evidence in case of dispute, unless the Client proves otherwise. In cases where the collaboration has commenced through Setin Designs (e.g., acceptance of an offer by email and payment of an advance), such communication and related evidence (offers, invoices, payments) shall be deemed valid authorization and carry equivalent evidential value. 13.8 Survival Provisions intended to survive termination (liability, indemnification, AUP, data protection, governing law) shall remain in full force. 13.9 Entire Agreement These Terms of Service, together with the incorporated policies (AUP, SLA, Privacy Policy), constitute the entire and exclusive agreement between HosteDomains (as a platform providing hosting and domain name services) and the Client, solely with respect to these specific services. This clause does not affect any separate contracts or agreements that may exist directly between the Client and Setin Designs for other services (e.g., website development, digital marketing). 13.10 Headings Section titles and headings are for convenience only and shall not affect interpretation. 13.11 Jurisdiction / ICANN & Registrar Rules Domain name services are subject to the international regulations and policies of ICANN, Registries, and partner Registrars (e.g., Netim, eNom). In case of conflict with these Terms, such regulations and policies shall prevail, without affecting the application of Greek Law with respect to the performance of this Agreement.  
  1. 14. Privacy Policy

14.1 GDPR Compliance HosteDomains / Setin Designs processes personal data in accordance with the General Data Protection Regulation (GDPR – EU Regulation 2016/679) and applicable Greek legislation. 14.2 Purposes of Processing Client personal data is collected and processed exclusively for the following purposes:
  • provision and billing of services,
  • communication regarding the service,
  • fulfillment of legal obligations (e.g., tax compliance),
  • improvement of service quality.
14.3 Data Collected HosteDomains may collect and store data such as:
  • contact information (name, email, phone, address),
  • billing details (VAT ID, Tax Office, business name),
  • client account information (username, login, ticket history),
  • technical data related to service usage (IP addresses, logs).
14.4 Data Disclosure Personal data will not be shared with third parties except when:
  • required to complete the service (e.g., domain registrars, datacenter providers),
  • required by law or by judicial/administrative authority,
  • explicitly authorized by the Client.
14.5 Client Rights The Client retains all GDPR rights, including:
  • access to their data,
  • rectification of inaccurate data,
  • erasure (“right to be forgotten”),
  • restriction of processing,
  • data portability,
  • objection to processing.
To exercise these rights, the Client may contact info@hostedomains.com. 14.6 Data Retention Data will be retained only for as long as necessary:
  • to provide the services,
